Updated 29 November 2024 PLEASE READ THE FOLLOWING CAREFULLY BEFORE INSTALLING AND/OR USING THE EXTENSION OR USING THE WEBSITE. 1. General
Azguard Wallet, referred to as “Azguard,” “we,” “our,” or “us,” is a browser-based self-custody smart contract wallet designed to enable users to manage cryptoassets and interact with decentralized blockchain networks. The Extension is specifically designed to operate within the Aztec ecosystem, a privacy-preserving Layer 2 solution built on Ethereum, with a strong emphasis on privacy, security, and user control over personal data. These Terms of Use (the “Terms”) govern your access to and use of the Azguard Wallet Extension. By downloading, installing, or using the Extension, you agree to be legally bound by these Terms and enter into a binding agreement with Azguard. If you do not accept these Terms, you must immediately cease using the Extension, remove it from your browser, and discontinue all related activities. Azguard reserves the right to amend or modify these Terms at any time, at its sole discretion, to reflect changes in laws, technology, or operational practices. Any updates will be communicated through the Extension or our website, with at least 15 days’ notice for significant changes. Your continued use of the Extension after the notice period constitutes your acceptance of the revised Terms. 2. Functionality
The Azguard Wallet Extension is designed to empower users with a secure, privacy-first interface for managing their cryptoassets and interacting with blockchain networks. Specifically tailored for Aztec, the Extension enables shielded transactions, which obscure sensitive information such as sender and recipient identities, transaction amounts, and on-chain activity. Through the Extension, you can generate or import a seed phrase to establish a self-custody wallet, securely store your private keys locally on your browser, and manage blockchain addresses. Your wallet data, including private keys and seed phrases, is encrypted and stored locally, ensuring no third party, including Azguard, has access to this information. The Extension also provides features for viewing balances, transaction histories, and other blockchain-related data. In addition, you can use the Extension to interact privately with decentralized applications (DApps), decentralized finance (DeFi) protocols, and staking platforms. Azguard does not monitor, track, or control your activity within the blockchain ecosystem, ensuring complete autonomy and confidentiality in your transactions. 3. Your Responsibilities
As a user of Azguard Wallet, you are solely responsible for the secure management of your wallet credentials and for ensuring compliance with applicable laws and regulations. You must take all necessary precautions to safeguard your seed phrase and private keys, as these are the only means of accessing your wallet. Azguard cannot recover or restore your wallet if your credentials are lost or compromised. We strongly recommend that you create multiple backups of your seed phrase and store them in secure, offline locations inaccessible to unauthorized parties. Additionally, it is your responsibility to ensure that the devices and browsers used with the Extension are free of malware, viruses, or other vulnerabilities that could compromise the security of your wallet. Any losses resulting from compromised devices, unauthorized access, or user negligence are entirely your responsibility. You must also verify all transaction details, including recipient addresses and transaction fees, before confirming any blockchain operations. Blockchain transactions are final and irreversible, and Azguard cannot cancel or amend them once submitted. Finally, you agree to use the Extension lawfully and ethically. The use of Azguard Wallet for concealing the origin of funds, obfuscating transactions, or engaging in any activity designed to conceal the source of illicit, sanctioned or incriminating funds is strictly prohibited. 4. Eligibility
To use the Azguard Wallet Extension, you must meet specific eligibility criteria. First, you must be at least 18 years old or the legal age of majority in your jurisdiction. The Extension is not intended for use by minors, and you agree to ensure that only eligible individuals have access to your wallet. Furthermore, you must not reside in a jurisdiction where the use of self-custody wallets, privacy-preserving technologies, or cryptoassets is restricted or prohibited. By using the Extension, you affirm that you are not a national or resident of any country subject to international sanctions or trade restrictions, including those imposed by the United Nations, the United States Office of Foreign Assets Control (OFAC), or similar authorities. It is your responsibility to ensure that your use of the Extension complies with all applicable laws in your jurisdiction. Azguard is not liable for your failure to comply with these legal requirements. In order to comply with all applicable laws and to prevent the Extension from being used for illegal purposes while maintaining privacy, the developers reserve the right to program the wallet contracts so that only transactions that meet their specific requirements are allowed in certain wallet functions. 5. Privacy
Azguard Wallet is a privacy-first solution, providing users with enhanced control over their personal data and digital activity. The Extension is designed to ensure that sensitive wallet data, such as private keys and seed phrases, remains encrypted and stored locally on your browser. Azguard does not transmit, store, or access your wallet data at any time. In addition to protecting wallet data, Azguard’s integration with Aztec enables shielded transactions that preserve the confidentiality of user activity on the blockchain. Transaction details, including sender and recipient information and amounts, are obscured to enhance privacy. While Azguard may collect anonymized diagnostic data, such as error logs and usage metrics, this data is stripped of any personally identifiable information and used solely to improve the Extension’s performance. Azguard does not share, sell, or monetize user data under any circumstances, further emphasizing its commitment to user privacy. This functionality also remains completely under the user's control and can be turned off in the Extension's settings. 6. Risks
Using Azguard Wallet involves inherent risks associated with blockchain technology, cryptographic systems, and privacy-preserving protocols such as Aztec. By using the Extension, you acknowledge and accept the following risks: - Blockchain and Network Risks: Public blockchains and Layer 2 solutions like Aztec are decentralized systems that may experience delays, congestion, or vulnerabilities beyond Azguard’s control.
- Market Volatility: Cryptoassets are subject to extreme price fluctuations that can result in significant financial losses.
- User Errors: Mistakes, such as sending cryptoassets to incorrect addresses, using incorrect transaction types, failing to back up credentials, or setting inadequate transaction fees, can lead to irreversible losses.
- Technological Risks: Advances in cryptographic technology, such as quantum computing, may compromise blockchain security.
- Privacy Limitations: While Aztec enhances privacy, certain metadata or interactions outside the Extension may still expose information.
You are solely responsible for understanding and mitigating these risks when using the Extension. 7. Non-Custodial Nature
Azguard Wallet operates as a fully non-custodial wallet, meaning you retain complete control over your private keys, seed phrases, and cryptoassets at all times. Azguard does not store, manage, or have access to your wallet credentials, making it impossible for us to recover your wallet if these are lost or compromised. The responsibility for securing and managing your wallet lies entirely with you. By using the Extension, you agree that Azguard cannot be held responsible for any loss of assets resulting from your failure to safeguard your wallet. 8. DApp Interactions
The Azguard Wallet Extension enables users to connect securely with decentralized applications (DApps) on Aztec and beyond. These interactions include accessing DeFi protocols, decentralized exchanges, and other blockchain-based platforms. Azguard does not control or endorse third-party DApps. Users must review and understand the terms and risks of any DApp they interact with. Any issues, including financial losses or security breaches, arising from DApp interactions are solely the responsibility of the user. Azguard is not a financial institution, investment company, broker, money transmission provider, money service business, payment service provider or a company similar to them. Azguard is not a buyer or seller in exchange operations made between users, and is also not a market maker. Its activity is not subject to financial regulation of any jurisdiction. 9. Fees
The Azguard Wallet Extension is provided free of charge. However, transactions on Aztec or other blockchain networks require users to pay network fees (e.g., gas fees). These fees are determined by the L2 and L1 networks and are outside Azguard’s control. 10. Intellectual Property
Azguard Wallet and its associated content are proprietary to Azguard or its licensors. You are granted a limited, non-exclusive license to use the Extension for personal purposes. Unauthorized modification, reproduction, or distribution is strictly prohibited. 11. WARRANTY DISCLAIMERS
THE AZGUARD WALLET EXTENSION, ALONG WITH ANY ASSOCIATED SERVICES, IS PROVIDED TO YOU STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES, GUARANTEES, OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, AZGUARD EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. AZGUARD MAKES NO GUARANTEES THAT THE EXTENSION WILL: - BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
- MEET YOUR EXPECTATIONS OR REQUIREMENTS;
- BE FREE FROM VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS;
- BE COMPATIBLE WITH ALL DEVICES, SOFTWARE, OR OPERATING SYSTEMS;
- PROVIDE ACCURATE, COMPLETE, OR RELIABLE DATA OR INFORMATION, INCLUDING BALANCES, TRANSACTION HISTORIES, OR NETWORK FEES.
AZGUARD DISCLAIMS ANY RESPONSIBILITY FOR ERRORS, INTERRUPTIONS, OR MALFUNCTIONS CAUSED BY BLOCKCHAIN NETWORKS, DECENTRALIZED APPLICATIONS, OR THIRD-PARTY SERVICES THAT INTERACT WITH THE EXTENSION. THE INTEGRATION WITH AZTEC OR OTHER NETWORKS MAY ALSO BE SUBJECT TO LIMITATIONS, INCLUDING DELAYS, VULNERABILITIES, OR TECHNICAL FAILURES, FOR WHICH AZGUARD IS NOT LIABLE. YOU ACKNOWLEDGE THAT THE SECURITY AND FUNCTIONALITY OF YOUR WALLET DEPEND ON FACTORS OUTSIDE AZGUARD’S CONTROL, INCLUDING YOUR DEVICE, BROWSER CONFIGURATIONS, INTERNET CONNECTION, AND THIRD-PARTY SERVICES. IT IS YOUR RESPONSIBILITY TO ENSURE THAT YOUR ENVIRONMENT IS SECURE AND MEETS THE MINIMUM REQUIREMENTS TO OPERATE THE EXTENSION SAFELY AND EFFICIENTLY. SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. IN SUCH CASES, THE ABOVE DISCLAIMERS WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW IN YOUR JURISDICTION. 12. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AZGUARD AND ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE AZGUARD WALLET EXTENSION. THIS INCLUDES, BUT IS NOT LIMITED TO: - LOSS OF PROFITS, INCOME, OR REVENUE;
- LOSS OF DATA, INCLUDING PRIVATE KEYS OR SEED PHRASES;
- DAMAGE TO HARDWARE OR SOFTWARE CAUSED BY YOUR USE OF THE EXTENSION;
- LOSS OF ASSETS DUE TO TRANSACTION ERRORS, NETWORK FAILURES, OR MALICIOUS ATTACKS;
- BUSINESS INTERRUPTIONS, LOSS OF OPPORTUNITY, OR LOSS OF GOODWILL.
13. Suspension and Termination
This Agreement is effective until terminated by Azguard or you. Azguard reserve the right, at any time, to: (i) discontinue or modify any aspect of the Extension; and/or (ii) suspend or terminate this Agreement and your use of the Extension with or without cause, and shall not be liable to you or any third party for any of the foregoing. If you object to any term or condition of this Agreement or any subsequent modifications thereto, or become dissatisfied with the Extension in any way, your only recourse and remedy (and our sole liability and/or obligation) is to immediately discontinue use of the Service. Upon termination of this Agreement, you shall cease all use of the Platform. Azguard reserves the right to discontinue the support and development of the Extension, with or without notice, under the following circumstances: - Violation of Terms: If any users breach these Terms or engage in prohibited activities, such as using the Extension for illegal purposes, including but not limited to fraud, money laundering, or terrorism financing.
- Compliance with Laws: Azguard may stop the development if required to comply with applicable laws, regulations, or legal obligations, including sanctions or restrictions imposed by government authorities.
- Security Concerns: If Azguard detects unauthorized access, potential threats to the security of the Extension, or activities that may harm Azguard or its users, it may temporarily or permanently discontinue the support and development.
- Discontinuation of Services: Azguard retains the right to discontinue or modify the Extension or any of its features at its sole discretion, for any reason, including technological, regulatory, or operational changes.
- BUSINESS INTERRUPTIONS, LOSS OF OPPORTUNITY, OR LOSS OF GOODWILL.
Upon discontinuation of support and development, you are solely responsible for exporting or backing up any relevant data or information associated with your wallet before losing access to your funds. Azguard is not liable for any loss resulting from discontinuation of support and development. You expressly waive any right to a trial by jury or to participate in class action lawsuits or other collective proceedings against Azguard. However, if you reside in a jurisdiction where these waivers are not enforceable, such provisions may not apply to you. Azguard encourages users to resolve disputes amicably by contacting our support team before pursuing legal action. 14. Amendments
Azguard reserves the right to amend, modify, or update these Terms at any time. Substantial changes that may affect your rights or obligations will be communicated through the Extension or our website, with at least 15 days' notice before such changes take effect. Your continued use of the Extension following the notice period constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Extension and uninstall it from your browser. Azguard is not responsible for your failure to review updates or changes to these Terms. It is your responsibility to regularly check for updates to ensure continued compliance with the applicable Terms. 15. Support
Azguard offers free technical support to all users of the Extension to ensure a smooth and secure experience. However, this support is provided without any warranty or guarantee of resolution. Azguard reserves the right to discontinue support services or deny assistance to users who fail to act respectfully or fail to comply with these Terms. 16. License
The Azguard Wallet Extension was developed under a GPLv3 open source license and may include open-source components governed by their respective licenses. You may not reverse engineer, decompile, or otherwise modify the software without explicit written permission. For questions about the licensing terms, refer to the Extension’s documentation or contact us. 17. Entire Agreement
These Terms, along with Privacy Policy and any policies or guidelines referenced herein, constitute the entire agreement between you and Azguard regarding the use of the Wallet Extension. They supersede and replace all prior agreements, communications, or understandings, whether oral or written, related to the subject matter of these Terms. If any provision of these Terms is found to be invalid, unenforceable, or contrary to law, the remaining provisions shall remain in full force and effect. Failure by Azguard to enforce any right or provision of these Terms shall not constitute a waiver of such rights or provisions. Any waiver must be expressly agreed upon in writing to be valid.
